These Terms of Use (“Terms”) govern your access to and use of the website located at datym.ai and its subdomains, including the blog (together, the “Site”), operated by Datym LLC, a California limited liability company (“Datym,” “we,” “us,” or “our”).

These Terms apply to the Site only. Access to and use of the Datym application at workspace.datym.ai is governed by a separate written agreement between Datym and the customer organization. If there is any conflict between these Terms and that agreement with respect to the application, the agreement controls.

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

You may use the Site for lawful purposes and in accordance with these Terms. You agree not to:

use the Site in any way that violates applicable law or regulation;
attempt to gain unauthorized access to any part of the Site, or to any systems or networks connected to the Site;
use any automated means, including bots, scrapers or crawlers, to access the Site or collect content from it, other than search engines indexing publicly available pages;
introduce viruses, malicious code or other harmful material;
interfere with the proper working of the Site or impose an unreasonable load on our infrastructure;
copy, reproduce, republish or redistribute Site content except as expressly permitted below.

2. Content and Intellectual Property

The Site and its contents, including text, graphics, logos, images, screenshots, software and the selection and arrangement of the foregoing, are owned by Datym or its licensors and are protected by copyright, trademark and other intellectual property laws.

“Datym” and the Datym logo are trademarks of Datym LLC. Other names and logos appearing on the Site may be the trademarks of their respective owners and are used for identification only.

You may view, download and print pages from the Site for your personal or internal business use, provided you keep all copyright and proprietary notices intact and do not modify the content. You may share links to Site pages and quote short excerpts from blog posts with attribution and a link to the original. Any other use requires our prior written permission.

3. Informational Purposes Only

Content on the Site, including blog posts, is provided for general informational purposes. It reflects the views and experience of its authors and does not constitute medical, scientific, regulatory, legal or professional advice. Nothing on the Site should be relied upon in place of the underlying scientific literature, congress materials or the judgment of qualified professionals.

References to third-party products, studies, abstracts, congresses or organizations are for illustration only and do not imply endorsement by or affiliation with Datym, or endorsement of Datym by them.

4. Accounts and Access Requests

Requesting access to the Datym application through the Site does not create an account or entitle you to use the application. Access is provided at our discretion under a separate agreement. Any information you submit through a contact or access-request form must be accurate and yours to provide.

5. Third-Party Links

The Site may contain links to third-party websites, including congress and society websites, publishers and social networks. We do not control and are not responsible for the content, privacy practices or availability of those sites. Links are provided for convenience, and your use of any third-party site is at your own risk and subject to that site’s terms.

6. Privacy

Our collection and use of information through the Site is described in our Privacy Policy, which is incorporated into these Terms by reference.

7. Changes to the Site and to These Terms

We may modify, suspend or discontinue any part of the Site at any time without notice. We may also revise these Terms from time to time. The “Last updated” date at the top indicates when the current version took effect. Your continued use of the Site after a revision is posted constitutes acceptance of the revised Terms.

8. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT IS ACCURATE, COMPLETE OR CURRENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DATYM AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Datym and its members, managers, officers, employees, contractors and agents from any claims, losses, liabilities and expenses, including reasonable attorneys’ fees, arising out of your violation of these Terms or your misuse of the Site.

11. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.

12. General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and Datym regarding the Site. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
